Some of the best deals are yachts that were in the French tax-shelter program. Here is a description I gave to a client of mine:</div>
<div class="gmail_default" style="color: #222222; font-family: arial; font-size: large;">
The French government developed the "Loi Pons" tax shelter program to help stimulate the tourist economies of the French Overseas Territories such as St Martin, Martinique, Guadeloupe and Tahiti. So, the Certified Accountants in France will sell shares in yachts to their clients who need tax deductions. In some cases if they invest 50,000 Euros for a share in a yacht they will get a tax credit of 50,000 PLUS they get some depreciation allowances...so many French taxpayers like to do these. That is one reason why the French build more yachts than any other country. To qualify for the deductions the yacht must stay in charter service for 60 months ... that is why this particular boat we are talking about must stay in charter until March 2015 which is 5 months away. These investors almost never use the boat or even see it. </div>
<div class="gmail_default" style="color: #222222; font-family: arial; font-size: large;">
The charter companies like to "pre-sell" them in advance so they can then plan to order another boat to replace the boat that is "phasing out". So they will discount the boat if you will make a deal in advance. I have done hundreds of these deals and I feel they are some of the best "deals" out there.</div>
<div class="gmail_default" style="color: #222222; font-family: arial; font-size: large;">
Here is how the deal works;</div>
<div class="gmail_default" style="color: #222222; font-family: arial; font-size: large;">
- once you find the boat you want we make a written offer with a 10% deposit, get the offer accepted and do a survey and sea trial. If we find any problems at survey you can cancel the deal for just about any reason. After survey you usually have a week to "accept" or "reject" the boat. Sometimes after survey we give a "Conditional Acceptance" which means you will take the boat IF they do certain things like replace the sails, fix an unforeseen problem, or whatever. Sometimes the charter company demands more deposit down (like 30% total) once you "accept" the vessel.</div>
<div class="gmail_default" style="color: #222222; font-family: arial; font-size: large;">
- then, let's say the phase-out date is March 31, 2015 which is 5 months away. We schedule the surveyor to go back and re-inspect the boat upon phase-out to make sure there is no new damage. If new damage is found that costs less than 5% of the value of the boat to fix then the charter company must fix it and the Buyer must proceed with closing. If the damage is over 5% of the value of the sales deal then the Buyer has the option to cancel the sale and get a refund of deposit OR we negotiate with the Seller to repair it. </div>

- then when the boat passes the "second survey" the final amount is due and the charter company proceeds to deflag the vessel and transfer title. The French government then issues a deflag certificate which guarantees a clean title. It is the best title in the world because of this solid guarantee. This can take 3-6 weeks to get. </div>

There are a number of different programs out there and I have done them all so I know the good and bad of each...By far the best is the "Guaranteed Income Program" OR a "55% Down Program" because you know exactly what you are getting with no "surprises" and if there is an economic downturn or terrorist attack that kills air travel for a while then you don't suffer. In both programs the charter company covers all expenses (dockage, insurance, all maintenance, etc) and you get between 6-12 weeks/year owner use. You can often also get "reciprocal owner use" which means you can use your owner time on other boats (like if yours is not available) and in other locations all around the world. </div>

GUARANTEED INCOME: The charter companies will only do the guaranteed income program with certain models that are in high-demand. The Lagoon 52 is usually one of those. They will pay you 8-9%/year guaranteed (payable monthly so you can use the payment to cover a loan payment) for between 60 and 66 months. The 8% is based upon whatever you spend on the yacht including cost to deliver it to the base. so, for example, let's say you spend $1,000,000 your guaranteed annual payments will total $80,000 for at least 5 or 5.5 years. The yacht will probably have to be kept in a high demand charter destination such as the BVI or St Martin.</div>

55% DOWN PROGRAM:</div>

In this program they cover all expenses and you put down 55% of the cost of a new boat. They use the charter income to service a loan they get from a French bank or leasing company. Then in "month 66" you pay $1 and they transfer title to you. </div>

This is just an overview and I can talk for hours about these programs so give me a call with questions...Different charter companies allow varying amounts of options but they prefer that you keep it the same as all their other boats in the fleet because some options require extra maintenance and since they pay for all that they want to limit high-maintenance options.</div>

Let's talk about charter management...I have been involved with this for 24 years and was the Managing Director of a charter company in the BVI. There are two ways to do this:</div>

<b>1. Buy a new boat from a charter company and get a guaranteed income</b>... You will ONLY get income guarantees if you buy a new boat. Their programs normally last 5.5 years or 66 months. The boat will earn between 8%-10% per year of whatever you spent to buy the boat. So, for example, if you buy a 300,000 Euro boat you will get 8% (or 24,000 Euros/year payable monthly for 5.5 years) if it is an Owner's Version catamaran (because it will not get as much business) ... or you can get up to 10% Guaranteed Income if you buy a "Charter Version" catamaran which will work more weeks/year so they can afford to pay you more.....but these "Charter Versions" depreciate more rapidly than Owner Versions so you have to factor this into your "exit strategy" (when you go to resell your boat)....You will have no expenses in the Guaranteed Program because the charter company pays all of those. You will get some "Owner Use" (but sometimes only 2-3 weeks in the high season) and you get "Reciprocal Use" which means you can use a similar boat at another location if you prefer...so you can cruise all over the world at the various bases...What other investment will pay you 8-10% guaranteed and you can have fun with it!?! I do recommend doing the 8% program because when you resell your boat it will be in high demand and you won't be competing with 40 other owners who HAVE to sell. </div>

There are also "Variable Programs" but I'd never recommend this because you could get left "holding the bag" and end up with nothing, or worse, owing the charter company money and having your boat beat to death.</div>

<b>2. If you buy a used boat and place it in charter there are NO GUARANTEES</b>. Every charter company that will take used boats has a different program. Some give you 70% of the gross charter income and charge you for every possible expense...others split 50-50 and split some of the expenses...<i>But it's all meaningless</i> because a creative charter company accountant can charge a lot of expenses to your account and you can end up with nothing or even owe them money!...so don't get all wrapped up in comparing charter company programs. It is mostly fiction and it will drive you crazy. Instead, ask the charter company for some Owner references and contact some owners who have boats in their fleet like what you have....and ask the owners what they are actually netting every year. Usually placing a used boat in a charter fleet is only going to cover some of your expenses and there will not be much of anything left over for you at the end of the year. And there will be "wear and tear" on your boat. But you may cover the cost of insurance, dockage and maintenance...and the boat is professionally maintained...so that's why owners place their used boats in charter.</div>

Lagoons and Leopards make the best charter boats in my opinion (when talking about $250k-800k boats)...Catamarans are the best because you have maximum staterooms, double the room of a monohull and the boat is super-stable (for those charter guests prone to seasickness this is a must)........I have owned two Lagoons and like them a lot... we can get you a 3-5 year old boat and capture the most depreciation but get the most maintenance-free boat possible....in the charter business most charterers want to bring as many people as will fit. So the cost of the vacation on a "per person basis" is the lowest... so the 4 and 5 stateroom charter versions are better for this...your utilization will be higher with a "charter version" boat than an "Owner Version" boat...so, for example, in the BVI you may get 16-23 weeks/year of charter with a "charter version" boat and the "Owner Version" boat may only do 11-14 weeks...so you have to decide what is more important to you.</div>

Yes, I like flybridges a lot because they become the focal point for sunset cocktail parties and having coffee in the morning...and also whilst underway everyone wants to be up there...I also think it's safer because you can see much further ahead (especially at night) when you are higher up...you also gian more usable square footage in the cockpit...a few people will say "but they have to raise the main and you lose sail area" to accomodate a flybridge... but in my opinion the drawbacks to losing a few square feet of sail area are far outweighed by the benefits of a flybridge...<b>the best boat in the price range we are talking about? The Lagoon 500 (5 stateroom version) with mini-flybridge...the Lagoon 560 and 620 are awesome big sisters.</b></div>

There is a sailing school in Miami (where I am an instructor) called Castle Harbor Sailing School where you can take the beginning sailing courses...it's best to learn on a smaller keelboat because they are more sensitive to the wind and I think you gain a better knowledge of boat handling on a smaller keelboat than a larger (more sluggish) keelboat.... and then I recommend taking the week long live-aboard catamaran course in the Bahamas with Bluewater Sailing School...this will get you some basic knowledge</div>

I was a captain of some sailing yachts that were in charter in the Bahamas and Florida Keys in the 1980's and 1990's...I was mostly doing "instructional charters"; that is, I was mostly teaching a liveaboard sailing course...(Beginning Coastal Cruising and Intermediate Coastal Cruising) in an ASA Sailing School.... Our season was compressed into 4 winter months and we were very busy....I enjoyed exploring the islands with customers and showing them the great places we have around here...I still do enjoy that ...In one year, the charter company booked me 7 weeks in a row on "instructional charters" (like the one you may do with Bluewater in the Bahamas) and, each week, I'd have a half-day back at the dock to see my girlfriend, do my laundry, answer my mail and get everything else done...and I just burnt out...the charter company didn't have any other qualified captains at the time so they begged me to do these charters...it was just too much and I decided to "swallow the anchor" and stay ashore as a yacht broker and I still do instruction but only work 5-8 hours a day one or two days a week....remember, doing crewed charter can be long hours (wake up, get breakfast going, fix mechanical problems, get underway to the next anchorage, get lunch going, stay up late partying with charterers etc etc)... I urge you to have balance in your life as a yacht crew and NOT go out 7 weeks in a row like I did that one year! </div>

3 staterooms allow more storage space in the Owner's Suite that makes it easier to "kill the clutter"...but many buyers find that the $20,000-60,000 premium for a 3 stateroom version isn't worth it to them...the last time I lived on a cat I had a late model Prout 45 with 4 staterooms and it was just my wife and I...we turned the 4th stateroom into a store-room and absolutely filled it up to the top with stuff we really liked having: folding bikes (I think these are a great thing to have and when stored below last much longer and don't clutter up the deck), water toys (rafts, noodles), spare parts, extra tarps and awnings for monsoons, colder weather clothes, luggage for taking short side trips, and the best thing is to <i>stock up on paper towels, toilet paper, cases of beer and other bulky items</i> from WalMart to last you 6 months...this saves time and money and we also use them as trade items. I don't drink beer but if you run into a lobster fisherman in the middle of nowhere you can sometimes trade a cold beer for a 1.5 lb lobster or a fully cleaned fish... </div>

I believe that the best way to go about this is to first establish a budget. Then focus on the newest/lowest-hours boats even if you have to go smaller in size...but first you have to determine what "makes/models" appeal to you... some of the late model 40' boats have as much usable interior space as 10-15 year old 45'-47' boats because the space designers got better! The smaller boats may not sail quite as well in some choppy conditions but usually interior space and comfort while at anchor or at the dock <i>becomes much more important than sailing</i> 1 knot faster with a little less hobby-horsing. At least that's what I and many experienced live-aboards think....</div>

For whatever this is worth: I think the most important factors in order of importance are:</div>
<div style="font-family: arial; font-size: small;">
- <b>usable interior space</b> in the salon/galley.... galley up because you "remain part of the party" and don't become a galley slave...Fountaine Pajots have the least interior space</div>
<div style="font-family: arial; font-size: small;">
- well-maintained or<b> late model machinery</b> that isn't likely to break while you are in the middle of nowhere...I spent a lot of my early days "fixing stuff" and nowadays I dont want to do much of that. I prefer to spend my time having fun: exploring new islands, snorkeling, meeting sailors for drinks and good food, sharing the best islands with people who haven't seen them yet...I DO NOT like sweating my butt off in an engine room, getting grease permanently ingrained in my fingernails, getting my clothes full of oil and grease and having engines conk out at the "wrong time"...I have already had more than my share of that and I'd rather go smaller/newer/simpler and have an easy life. </div>
<div style="font-family: arial; font-size: small;">
- a <b>raised steering station</b> or better-yet: <b>a flybridge</b> (it's safer because you have better visibility underway especially at night and it's a great party platform at anchor)...so what (!), if the mainsail is 15% smaller! They are usually overpowered anyway.</div>
<div style="font-family: arial; font-size: small;">
- <b>side tables by my bed</b> so I can keep all my "stuff" nearby...OK, I know this is quirky but it's important to me...FP's usually dont have room for this</div>
<div style="font-family: arial; font-size: small;">
- <b>cockpit enclosures</b> so rain doesn't overpower you and the cockpit then becomes another "room" in all conditions</div>
<div style="font-family: arial; font-size: small;">
- sailing characteristics are over-rated...I qualified for the 1980 US Olympic Sailing Team and raced Tornados for a while...so I know something about speed in a cat...and 90% of the time it's not the boat making things go slow...it's the guy steering the boat and setting up the sails or course wrong for those winds. Also: in my opinion: if you are in a hurry, take a plane! They are much more efficient than boats.</div>

More importantly for the market as a whole, sales of powerboats also rose 4 percent, to 3,123 boats.<br />
Better sales were reported among all sizes of boat 45 feet or shorter, with 1,691 closings for boats under 35 feet, a 4 percent gain. In the 36- to 45-foot range, sales were 3 percent higher, with 759 boats sold. The only size range to record lower sales was 46 to 55 feet, down 3 boats compared to May 212, with 178 boats sold.<br />
Big-boat sales were also strong. Among superyachts (over 80 feet), 20 were sold, up 10 from the year before. And in the 56- to 79-foot size, 82 boats changed hands, up from 76.<br />
The total value of boats sold in May rose by $98 million, mainly on the strength of superyacht sales (up $91 million). By contrast, boats 56 to 79 feet sold at a total price that was $6 million or 10 percent below the previous May. The market under 55 feet made up the difference, with a total value gain of $13 million.<br />
Through the first five months of the year, overall sales were 1 percent lower than in 2012, with 12,659 boats sold. The total value of the boats sold was 15 percent higher, with $1.66 billion changing hands.</td></tr>

<span style="font-family: arial; font-size: x-small;">It varies from person to person and by type of yacht...If Donald Trump owned the same boat as me, he'd probably see the need to spend double what I think needs to be spent.....if we are talking about a 20 year old cat that was not maintained well, then there could be major refit money needed justto make it insurable ... I have heard very general estimates of "10% of the value of the yacht on an annual basis". But that really doesn't make sense when you consider that a new boat has very little maintenance in the first year ...and boats are like cars...once they get to a certain age (7-10 years) all the components start to fall apart...so maintenance becomes a larger issue "late in the life of the boat"...you will find a discussion about holding/running costs at the end of my report I sent you...<b>the major ones are:</b></span><br />
<span style="font-family: arial; font-size: x-small;"><br /></span>
<div style="font-family: arial; font-size: small;">
- <b><i>financing/cost of money</i></b>...if you don't have a loan then it's the foregone returns you would have made investing the money elsewhere</div>
<div style="font-family: arial; font-size: small;">
- <b><i>insurance</i></b> (some people "self-insure" or get "liability only" coverage so you'd have little/no out-of-pocket expense)...for "full navigation coverage" it is 1.5% of the declared hull value (as an annual premium) if you go with a major underwriter. If you are not using the yacht for part of the year be sure and tell your agent to convert to "port risk" coverage and you may get a refund of half the premium for that period...</div>
<div style="font-family: arial; font-size: small;">
- <b><i>dockage</i></b> (anchor the boat somewhere and that cost can be zero...stay in a fancy marina and it can be $20/foot per month...so, in the full service marina, a 40' cat costs $800+tax/month...I can find homeowners with docks behind their houses who charge $10/foot/month and you can save some money)</div>

- <b><i>maintenance</i></b> (some people delay annual recommended maintenance but you have to be careful about that because sometimes it comes back to haunt you)...best to budget for bottom jobs, servicing sail drives/engines/new zincs, replace sails in year 5 (I know some sailors who can get 10-20 years out of a sail), periodic detailling-cleaning</div>

- fuel is usually a minor expense on a sailing cat....not so on a power cat</div>

When you narrow down a particular make/model I can quantify the expenses noted above so you know what dollar amount to expect...</div>

One way some people <i>eliminate</i> the holding/running costs is to buy a new yacht in a charter fleet. They will have no expenses whatsoever for 5.5 years (the normal length of a charter program)...they will get a guaranteed income for 5.5 years (between 8-10% of the new cost of the yacht...So, if it cost $500k new, you get to $40k-50k/year in income for 5.5 years)...they use the boat when it's not chartered out....they can also use similar boats at 30 other locations worldwide...by the end of the program you either sell the yacht or sail it away ...</div>

Prices are falling on these and the last lowest price I saw was $1150. Then buy 500 minutes (usually costs $1/minute)...then install apps called Ocens Mail and Ocens Weather ($59) ... Now you have satellite voice, eMail and weather forecasting capability. This is 100% reliable (unlike those old-fashioned SSB based eMail programs). When receiving and sending eMail just connect the phone to the satellite for a minute and the outgoing mail blasts out and incoming mail zooms in.... so you only use a minute of satellite time. You also have the ability to make satellite phone calls which comes in very handy in emergencies. And you can get weather forecasts worldwide... </span></div>

Island Spirit, a well-respected bluewater catamaran builder, has finished building their newest model, the 38 PowerCat. Let me try to be succinct.... if you can find a really well-maintained Lagoon 37 or 42 then none of what I'm about to say matters.... but the ones in the price range you have been looking at generally need a lot of work and have not been well-maintained. Yachts are like cars in that: at a certain age, everything starts to fall apart. And the repair bills can be endless and you can spend all your time dealing with that and no time sailing/cruising. If you are a "tinkerer"/engineer-type then maybe this is quite alright ...(Are you?).......Different models reach the end of their "maintenance-free life" at different times (Leopard has the longest useful life) but generally the manufacturers have recently been using better materials and components so that the newer boats last longer. If I were in the market now and had to stick to a certain budget, I'd look for the newest boat possible by the best builder possible. The best production builders for 1999 onwards are Lagoon, Privilege, Leopard and Fountaine Pajot can be OK but stick to as late-model as possible and never buy one of their hull #1-5's (when new model comes out they always have screw-ups/leaks/issues and these dont always get remedied 100% by the manufacturer...FP has a terrible warranty reputation).... </div>

The 37 and the 42 had some flaws which are not limited to the following and maybe these aren't deal-killers for you:</div>

- their salons are small compared to more recent models....i.e., the newer-designed Mahe 36 has a larger salon than a Lagoon 42! But the 42 has a longer waterline and will sail a little better</div>

- the headliners were constantly falling down and the replacement headliners can almost never look decent</div>

- the flooring lasted about 15 years and needs replacing</div>

- the way the windows are designed creates a "hothouse effect" in the tropics that broils you when sitting in the salon...there are some partial remedies for this (Note: that is why Lagoon went to vertical windows)</div>

- on some 42's the engines were placed under the bunks and the inevitable oil spills/fuel spills on the engine stink up the interior. Some people get sick inhaling this....by the way, when I ran Moorings Yacht Brokerage for 10 years we went to Lagoon about this and they moved the engines aft and sealed them off from the living space but there are only a few models like this</div>

- The Antares are great cats... they are semi-custom, well-built boats hand-made in small volumes. I love the high freeboard and the space that creates down below, with the huge amount of "reserve buoyancy" that you will thank God for 1000x if you ever get into really big waves....But when Antares pays for components they pay full wholesale price because they buy one thing at a time. So, they just naturally cost more. Now, when a large builder like Lagoon, which is part of the Beneteau Group (who build thousands of CNBs, Wauquiez, Jeanneaus, Beneteaus, Lagoons, Antares power boats, Swift Trawlers, campers, automobiles, temporary housing, prefab housing, etc) buy engines, for example, they buy <i>hundreds at a time</i> and get them for less than half of what Antares pays. The same goes for sails, masts, rigging, electrical looms, plumbing parts, resin, etc. So, they build to the same quality for much less and they can afford to pass on a sizable discount to the buyer and still make a good return on their investment for the shareholders. I have owned two Lagoons and like them a lot. Outremer's are proven bluewater cruisers but they have wave slapping issues especially when you equip them with all the stuff most cruisers want and you give up some interior volume to get performance. In my humble opinion, speed is highly over-rated. Being able to go 1-2 knots faster because you are in an Outremer isn't worth the space you have to give up unless you race and want to win bets with other skippers. Privileges are the best-built cats in the world but being a low-volume builder usually cost a lot more than equivalent production boats, their salons are usually very small and to exaggerate a little: "They sail like slugs".... They also are like "hot houses" because their salons have windows directly exposed to the sun...So, in Seattle this wouldn't be noticed, but in the Caribbean it will drive you crazy in about 1 week because your aircons can't keep up and you will feel like a broiling piece of fish sometimes.</div>

I have lived on cats for extended periods and in my humble/biased opinion the most important factors are "live-ability/easy for one person to sail" which <i>supercedes everything else by a factor of 10;</i> and by that I mean, is the salon as large as possible? Does the galley have enough storage space? Is there plenty of storage space elsewhere so clutter isn't everywhere? Is there plenty of room in the engine space to do maintenance or do you need an army of trained midgets to change the oil or bleed the injectors? Is the engine space sealed off from the living space (so those nasty-inevitable smells never get into your space)? Is the steering station high up with good visibility and easy access to the deck when something goes wrong under sail? My most-recent stint aboard was a 6 month cruise to New England/Chesapeake during the summer/fall on a new Prout 45. We loved the large salon. We loved the large raised steering station. We spent 95% of our waking hours in these two spots and had the time of our lives. Having morning coffee and sunset wine in the raised steering station because the views were always awesome was memorable...the rest of the time (at night and in the pouring rain) was spent in the salon. In 6 months I sat down in the cockpit a grand total of two times, so I think large cockpits are a giant waste of space unless I'm docked in St Tropez and I want to watch the French bikini team walking the docks .... </div>

- another reason I like Lagoon and Leopards are because of this reason: they are used by more charter fleets than any other brand (because they "wear-well"). When you charter one, you are given a "comment sheet" to fill out. There are over 100,000 charter weeks sold per year on all the Lagoons and Leopards worldwide, so they get back <i>70,000</i> comment sheets....A lot of "Type A", very intelligent people charter these boats and they love to write for hours about what works well on the boat, (most-importantly) what doesn't, and what changes should be made in the next model. These manufacturers listen closely and incorporate changes every year, and it really does make a difference. Antares, Outremer and Privilege don't have this constant and massive input and couldn't afford to make the changes anyway because they aren't set up for this....so you see a lot of little nuances on these Lagoon/Leopard that really are nice. I can show them to you if we get together and look at some boats.</div>

- Regarding the 2005 Antares...here is a list of all Antares sold since 2008...I have full specs and photos of that one that sold in NC for $450k if you want to see them. She was on the market for over a year and the owner just wanted it gone so he accepted $100k less than he was asking at the time ... that happened in 2009. I have a private database that has all selling prices of all yachts sold since 1998 and will share all details with you....it costs me over $600/month for this.</div>

The Caribbean still has the best deals because we see an imbalance of sellers to buyers if you are considering production yachts...the Euro may be making a dramatic move and if Greece abandons the Euro and the "PIGS" (Portugal, Italy, Greece, Spain) can't cover their debt payments, then the Euro will drop against the dollar. If it goes to par, or below the dollar, then all those French tax shelter yachts will become huge bargains for Americans/Canadians/Aussies/<wbr></wbr>Kiwis...if the Euro doesn't make the move, be sure to play the seasonal price trends and locational discounts I mention in my eBook. The time to buy is between now and November 15th.......then again next summer...The Aussies are the biggest buyers in the world right now which is preventing the bottom from falling out of the market....because their currency is strong and they are mining gold and silver like crazy, they are spending money like drunken sailors...the Norwegians are right behind them... Norway has no debt and huge oil reserves and their economy is booming. Having a Viking heritage that genetically predisposes them to take advantage of crises elsewhere, they can't help themselves but to snap up bargains when they see them.</div>

Besides what you mentioned, I think you should look at Lagoon 440's/500's and Leopard 46's ...and when your wife sees how much more room you get in a Lagoon and the level of fit and finish of a Leopard (for significantly less money than an Antares) she will probably twist your arm in that direction... </div>

I really think you should focus on younger 4-6 year old yachts and not those older models you mentioned...Everything just starts falling apart at age 7 and it's never-ending (dealing with that) after that...Also, technology has improved in recent years and you see a lot of nice improvements.....so I think if you have a budget of "x" then it's better to go with a smaller newer (post 2007) boat than a larger/older "money pit" (a large hole in the water into which you pour money)...
